1. Overview

These Terms of Service ("Terms") are an agreement between you and Relaxa when you visit our website or buy from us. Please read them carefully.

By using the Site or placing an order, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

 

2. Our products and safe use

Relaxa massagers are personal wellness devices designed for relaxation and general comfort. They are not medical devices and are not intended to diagnose, treat, cure or prevent any disease or medical condition.

Please read the user guide before use and follow these safety basics:

• Talk to your doctor before use if you are pregnant, have a pacemaker or other implanted device, have a heart condition, diabetes, a recent injury or surgery, or any condition you are unsure about.
• Do not use on broken skin, swelling, open wounds, or directly on the front of the throat or the head.
• Keep sessions to the recommended length (around 15 minutes) and stop if you feel pain or discomfort.
• Heat settings can get warm; do not fall asleep while using heat, and supervise use by anyone with reduced sensitivity to heat.
• Not for use by children. Keep away from water and charge only with the supplied or a compatible cable.

Results vary from person to person. Customer reviews and statements on the Site describe individual experiences and are not a promise of specific results.

Product images and colours are shown as accurately as possible, but may differ slightly on your screen.

3. Orders, pricing and payment

Orders. Your order is an offer to buy. We accept it when we send your shipping confirmation. We may refuse or cancel an order, for example if an item is out of stock, there is a pricing error, or we suspect fraud. If we cancel after you have paid, we refund you in full.

Prices. Prices are shown in [USD] and include or exclude taxes as stated at checkout. Shipping costs, taxes and any import duties are shown before you pay. We may change prices at any time, but changes do not affect orders already accepted.

Bundles, gifts and promotions. Bundle prices and free gifts apply only to the bundle selected at the time of purchase and while stocks last. Discount codes cannot be applied after an order is placed and, unless stated, cannot be combined. If you return part of a bundle, the bundle discount may be removed and any free gift may need to be returned or its value deducted from your refund.

Payment. We accept the payment methods shown at checkout. Payments are processed securely by our payment providers; we never store your full card details. By paying, you confirm you are authorised to use the payment method.

4. Shipping, returns and warranty

Shipping. Orders are usually processed within [1–2] business days. Estimated delivery is [5–10] business days, depending on your location. Delivery times are estimates, not guarantees, and may be affected by couriers, customs or events outside our control. Risk of loss passes to you on delivery.

Returns and refunds. You can return your product within [90] days of delivery under our money-back guarantee. Contact us first at Relaxa to get return instructions. Full details, including who pays return shipping and when refunds are issued, are in our Refund Policy. This does not affect any rights you have under consumer law.

Warranty. Relaxa products come with a [1-year] limited warranty against manufacturing defects from the date of delivery. Where an extended warranty is included with your order, it extends this cover to [2 years] in total. The warranty does not cover normal wear, misuse, water damage, accidents, or use against the instructions. If a covered defect appears, we will repair or replace the product, or refund you if neither is possible. To make a claim, email us with your order number and a photo or video of the problem.

5. Accounts, use of the Site and content

Accounts. If you create an account, keep your login details safe. You are responsible for activity on your account. Tell us straight away if you think someone else is using it.

Acceptable use. You agree not to:

• Use the Site for anything unlawful, fraudulent or harmful
• Copy, scrape or resell our products, content or images without permission
• Try to hack, overload or interfere with the Site or its security
• Post false, abusive or misleading reviews, or reviews about products you have not used

Reviews and content you send us. When you post a review, photo or video, you give Relaxa a free, worldwide licence to use, display and share it on our Site, emails and social media, with your first name or username. You confirm the content is yours and is honest. We may remove content that breaks these Terms.

Intellectual property. The Relaxa name, logo, product designs, text, images and videos on the Site belong to Relaxa or our licensors and are protected by law. You may not use them without our written permission.

6. Third parties, disclaimers and liability

Third-party services. Our Site runs on Shopify and uses third-party tools for payments, shipping, reviews and marketing. Links to other websites are provided for convenience; we are not responsible for their content or practices.

Disclaimer. Apart from the warranty in section 4 and any rights you have under consumer law, the Site and products are provided "as is" and "as available". We do not promise that the Site will always be available or error-free.

Limitation of liability. To the fullest extent the law allows, Relaxa is not liable for indirect, incidental or consequential losses, such as loss of profits or data, arising from your use of the Site or products. Our total liability for any claim is limited to the amount you paid for the product involved. Nothing in these Terms limits liability that cannot be limited by law, including for death or personal injury caused by our negligence, or for fraud.

Indemnity. You agree to cover Relaxa for reasonable losses and legal costs caused by your breach of these Terms or misuse of the Site or products.

Changes to these Terms. We may update these Terms from time to time. The latest version will always be on this page with its effective date. Changes apply to orders placed after they are posted.

Severability. If any part of these Terms is found invalid, the rest stays in effect.
